Here at Wicker Mobility Shop our aim is for you to be completely satisfied with the service and products you receive. However, we recognise that there may be times when customers are unhappy with their purchase for one reason or another. Accuracy of content:

We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed exclusive of VAT if the VAT can be exempted if the item is being purchased for the personal use of a disabled person or for a registered charity and inclusive of VAT if the item can not be exempted. Any weights, dimensions and capacities given about the goods are approximate only. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.

Availability:

All items are subject to availability. Our website indicates the expected despatch time for each product ordered. If there is a delay in despatching any product over and above that indicated on the website we will inform you as soon as possible.

Ordering errors:

You are able to correct errors on your order up to the point on which you click on “submit” during the checkout procedure. If you spot an error after this, please contact us on 0114 272 3729.

Payment terms:

We will charge your credit card immediately prior to the despatch of your order. Your credit card will be authorised with the total amount when the order is placed, but this amount will not be taken from your card until immediately prior to the despatch of your items. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.

Delivery charges:

Delivery charges vary according to the type of goods ordered and cannot be refunded.

Delivery:

Please note that we are only able to deliver to addresses within the United Kingdom. We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time. All deliveries must be signed for (except items sent by post and which are small enough to be put through the letterbox).

VAT:

Many of the goods available for sale on this site can be exempt from VAT if they are for the personal use of an individual with a disability or being purchased for a registered charity. Items that can be exempt from VAT are shown on this site exclusive of VAT, while items that can not be exempt from VAT are shown inclusive of VAT.

When an item or items are initially added to your basket, the price of the item will always include VAT. When you enter the checkout procedure you will be able to claim VAT exemption and your basket will be updated to reflect this. Please note VAT is always charged on the courier delivery charge.

If you are purchasing the goods for the personal use of an individual with a disability, the goods being purchased must be specifically designed to aid your disability. The goods must also be for personal use and the person must be chronically sick or disabled.

For charity purchases, the goods must be being purchased for the domestic or personal use of a disabled person.

If you are in any doubt as to whether you are eligible to receive goods or services zero-rated for VAT you should consult notice 701/7 VAT Relief for disabled people or contact the National Advice Service on 0845 010 9000 before claiming VAT exemption.

Warning: Section 39.2 of the VAT Act 1994 provides for severe penalties for anyone who makes use of a document which they know to be false for the purposes of obtaining VAT relief.

Risk and ownership:

Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

Data Protection:

All customer details are retained for the use of Wicker Mobility Shop, part of Associated Chemists (Wicker) Ltd only and will not be released to any other company for marketing or mailing purposes without permission. Associated Chemists (Wicker) Ltd comply fully with the Data Protection Act.

Goods:

All goods sold will conform to contract i.e., be as described, fit for purchase and of satisfactory quality. All new goods carry a warranty of 12 months minimum (or up to the manufacturers warranty). The warranty excludes items classed as 'consumable' such as batteries.

Acknowledgement and acceptance of your order:

You will need to provide us with your e-mail address and we will notify you by e-mail to confirm receipt of your order. This e-mail will also contain full details of your order. An acceptance of your order will take place on despatch of the good(s) ordered.

Right to cancel:

Under the United Kingdom's Consumer Rights Act 2015, you have the right to cancel the contract for the purchase of items ordered at home within a period of 14 working days, beginning the day after the item is delivered. This applies to all of our products except we regret that we cannot accept cancellations of contracts for the purchase of the following items: Goods specially ordered, made to customer specifications, goods which are clearly personalised or goods which can not be returned due to hygiene reasons. To cancel we require written notification from you, by registered post, within 16 working days of the date of delivery. The goods must then be returned to us at your own cost (we recommend that all goods are returned by courier or by Royal Mail special delivery). We are not liable for any loss or damage to goods in transit. If the goods were originally delivered by us, the customer must make them available for uplift from their address on the date specified by us in writing. There will be a cost incurred for this collection service. Until the item is returned to us the customer has a duty to retain the goods and take reasonable care of them. Goods must be returned in the condition originally supplied i.e. complete, unused and "as new". Please note that all goods returned to us must be clean and free of any dirt and biological contamination to comply with current Health and Safety Regulations. If the above terms are met all monies paid for the goods will be refunded within 10 working days or receipt of the goods. Where initial payment was made by credit card we will refund the amount to that card. Any delivery costs will not be refunded and must be met by the customer. We reserve the right to withhold a percentage of the refund value of returned goods if the product or packaging is in such condition that the item needs to be reduced in price for resale.

Faulty items:

All items are tested before despatch but in the unlikely event that the item you receive is faulty, please contact us and we will arrange to have the item replaced or repaired at no cost, or alternatively offer to collect the goods and refund money paid.

Exclusion of liability:

Any disclaimers and exclusions of liability in these terms and conditions shall not apply to any damages arising from death or personal injury caused by our negligence. These disclaimers and exclusions shall be governed by and construed in accordance with English law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Damage to your computer:

We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Changes to legal notices:

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

Law, jurisdiction and language:

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
